Legal Question in Education Law in North Carolina

Recently I took a Healthcare registration exam at a testing center located in a H & R Block. The noise level was extremely high with H & R Block employees having conversations. I believe it highly contributed to my failing the exam by 1 point. Are there legal options that I can pursue? It is the final exam for becoming a Registered Respiratory Therapist. It requires a Respiratory Degree and makes an individual more or less 100% employable.

Unfortunately, it doesn't seem that you have legal recourse. I sympathize, I remember when I took the bar exam, it was very noisy and distracting. I also understand that it was the first and last time they used the venue where the exam was held that year.

Without knowing more about the specific rules of your licensing agency, this is impossible to answer. For instance, there is no right to appeal or fight the results of most professional exams, as there is no property right in a specific career path.
