my 17yr old son has a child with a 16yr old what are his legal rights

Fathers have a right to parent their children

AND, although you didn't ask,

Fathers have an obligation to support their children.

To protect his rights, he should work out a parenting plan with Mother.

To protect his child's right to support, Father and Mother should also have the child support division set a child support amount.

The father and mother have the same rights to the care, custody and control of their child.

I agree with Attorney Stevens about the parenting plan and support. However, since both your son and the child's mother are under age 18, that means that both you and the parents of the mother will have to provide the ultimate support for the child.
