Is age considered when granting visitation with noncustodial parent

I left ex in Aug of 06 taking 4 mo-old with me. He made no efforts to see her, and moved to Calif in Jan 07. In Sept of 07 we were in court for an exparte order ( he threatened to take her) and child support. At that time I was given custody and he was given visitation once a month, no overnights at this time. In March we go back to court and he will ask for overnights and weeks vacation. I feel he is not ready, nor is our daughter. His visits have not gone well, for example he fell asleep and let her choke on a quarter, brought her home ill, not realizing she had fever of 103, states he can't ''get her to eat'' for him, has let her fall injuring her head and then tried to hide it from me, admitted that he needed a parenting class but was ''too busy''. He really has no clue how to care for this child due to his infreq. visitation. I have offered to pay for additional plane ticket each month to help with this, and he refused, ''too busy'' he states. I just feel she isn't safe with him and needs to be older before overnights begin. I'm worried that the judge will grant him overnights and his weeks vacation, and not consider the cirumstances that I have described above. What can I do to protect my daughter until she is older?

Tell the Court exactly what you just typed. If all of that is irrefutable, then I wouldn't worry too much
