One who files for Divorce can include in the pleading a request for Post-Separation Support and Alimony. It is up to the Judge to determine whether or not to award such spousal support. Regarding your video tape question, without having spoken to you more, I would imagine that the tape would irrelevant to the issue of spousal support. Hello - I hope this reaches the person who posed the question. I am glad that I was reading my prior replies. I meant to write that a video tape could be RELEVANT. If it evinces "marital misconduct" as defined by the statute, this could be relevant for the purposes of PSS and Alimony. "Marital misconduct" is relevant - and is an issue - in PSS and alimony.
