Legal Question in Family Law in North Carolina

Bed and Board Divorce

After being caught in an affair and leaving the home for 6 weeks...all was forgiven and I returned several months ago. Now things have gone sour(suspicious and continued rehashing of the affair)and my spouce say's

her attorney is going to have me removed from the home next week ..she wants a six month(or more)seperation. The affair has been over since being caught and there are no domestic violence issues...however I think she will try to use mental cruelty (do to some cussing and name calling - by both

mind you). Thanks!!!

Re: Bed and Board Divorce

If the affair was forgiven, she shouldn't be able to use that against you, however, since NC is a no-fault divorce state, she doesn't need fault to sue for divorce. Fault does come in if alimony is sought.

This is not to be considered legal advice and no attorney/client relationship has been formed.
