Legal Question in Family Law in North Carolina

My boyfriend has a substantiated neglect charge by DSS. He also had allegations of sexual abuse against him but no convictions panned out in the investigation. Now my ex husband wants to sue me for custody based on this record. Currently we have joint and equal custody. Does he have a solid case for changing the custody?
