want to change custody

i used to live in nc and i now live in florida. my daughters father was abusive i left town after the last beating he motioned to stop paying child support order was terminated and now i want him to give up rights do not know of his wearabouts what do i do my husband wants to take responsibility for her and change her name

you will need to find him, I believe, unless the time eperiods have been very long.

Would he still be at the address he was when the child support order was terminated? If you want him to relinquish his parental rights, you must notice him to see if he objects. A step-parent adoption will require he be given an opportunity for input. Maybe he will sign a consent. You want this air-tight so the effort to find him is worth it. You will need an attorney to walk you through this.
