My daughter was granted permanent custody of her two sons when divorced in Florida. Due to financial constraints, an addendum to the original divorce decree was written to allow the father to have temporary custody until such a time the mother could provide for the children, with the agreement that should the children wish to go to live with their mother during this time, they should be allowed to do so. After the divorce the father moved to NC with the children and the mother moved to Georgia.The older son, age 10 has asked to live with his mother, and the father is blocking this request. The mother feels the child is being emotionally abused because of his request and has asked to have him moved to GA with her. Does my daughter need to seek legal counsul to follow through with this child's request? At what age can a child seek to live with another parent?

It sounds like either North Carolina of Florida law will apply depending on how long the children have lived in North Carolina. You will need to consult a lawyer in either of those jurisdictions.
