Legal Question in Family Law in North Carolina

child support

I am drawing unemployment after being laid off and am going to request a reduction in child support payments,however I have a substantial sum of money in investments,retirement and savings, how will this affect me from a legal standpoint if I file for a reduction because my income has changed.

Assets can be considered -- the "estate" of the parties but is not generally considered unless a Motion to Deviate from the NC Child Support Guidelines is filed.

You can't be required to deplete your assets to meet your current obligation.

File your motion - make sure you dot the i's and cross the t's and be prepared for the hearing. Hopefully, you have representation.
