Legal Question in Family Law in North Carolina

Client Privacy Rights

There was no case in NC.

I called lawyers, as any other weekend typically would go the past few months.

Accidentally called the opposing party's lawyer.

The next lawyer I called asked who the opposing party's lawyer is. Since I knew, I told her, and she talked to him. He told his client, and his client had a protective order filed on me, so I can't see my daughter.

All I was trying to do was get legal counsel retained. The protective order even states that I was searching for counsel 6 days prior to the protective order request, by someone who was NOT the opposing lawyer.

I told her there was no case in this state, and she still went to talk to the opposing party, before I'd hired her, or even done a consultation with her.

Furthermore, when she found out what my form of employment is, she raised the retainer $2500, and I didn't even have $2500 to begin with. I just wanted to visit my daughter.

I feel sabotaged by this, as her talking to his lawyer caused the trickle down effect of this protective order.

furthermore, there are no grounds for the protective order except that I have PTSD due to my ex raping me.

Re: Client Privacy Rights

It is standard for one party's attorney to communicate with the other party's attorney. Cases could not go forward otherwise. If you feel that your attorney has not properly represented you or that the fee is more than you want to pay, you can certainly hire someone else. You do need help getting the order lifted so you can at least have visitation. If you are going to switch attorneys, the sooner the better. Hopefully, you haven't yet paid the additional retainer you mentioned.
