can i get a divorce without having his consent

Yes, you can get the divorce even if the other person doesn't want it. You just have to have been separated for at least a year. If there are issues pertaining to child custody, child support, alimony, splitting the property, etc., you should consult a family law attorney. Otherwise, many courts now have do-it-yourself simple divorce kits that you can get from the clerk's office.
