Legal Question in Family Law in North Carolina

I had a court appointed attorney when i signed custody of my son over to my mother for a brief period of time. i have checked with the clerk of courts and she is still the person appointed to represent me in this matter. now that i have done everything to regain custody and i wish to motion the matter back into court. i have been trying to contact her since march of this year. it is now december and i have yet to speak to her. can i get a new court appointed attorney? what do i need to do? 9 months is a long time to blow off a client...

Generally, you will not be entitled to a Court appointed attorney for custody matters in North Carolina only criminal matters. Are you certain you had a Court appointed attorney? I suspect you are confusing Court appointed with some sort of Legal Aid program. If you do some how have a Court appointed attorney, you are generally stuck with them. However, like any other licensed attorney in NC if they are not doing their job you may report the issue to the State Bar - if there is a State Bar complaint, the Court may appoint new counsel to you.
