Legal Question in Family Law in North Carolina

I have custody of my son and his father has visitation but he has recently said that he would like to give up his rights I would like to amend the custody agreement and I would like to know the necessary steps to do that. I also would like an attorney but I don't have a lot of money to pay for one so if anyone knows a pro bono one that would be great thank you!

First, the father can not simply give up his rights. You would need to petition the Court to have his rights terminated and you would need a good reason. The state will be very reluctant to cut a parent loose from child support - oh, yeah, if his rights are terminated, in addition to not seeing the child any more - you no longer get child support and that puts the state and the tax payers in a potential position to have to pick up his end of the obligation - something most judges are very reluctant to do. So bottom line - you will need to consult a local family law attorney to discuss your options! Best of luck!
