Legal Question in Family Law in North Carolina

I want a divorce, but we have 2 children. We live in North Carolina but we moved here from Texas for a job. I want to move back to Texas but my husband wants to stay here. He also wants to split up our children, he keeps our 4 year old boy and I take our 4 month old daughter. He works out of town and would leave the raising of our son to his mother, who wants to stay in Texas but would be forced to move here. He doesn't realize that I want a divorce. If I leave and take the kids with me before the divorce what action can he take against me?

A custody action. Taking off with the kids could possibly put you in a bad light in terms of going to Court. Unless you have compelling reasons for leaving with the children such as to avoid physical and / or mental abuse, simply taking off with the children may not be such a good idea. You should consult with a local Family Law attorney to get all the options avaliable to you.
