Legal Question in Family Law in North Carolina
My divorce is out of the state of Arizona but my ex and I live in North Carolina. It is a simple divorce since we have no real property together since we were only married 6 weeks. We separated on October 1st and since then i've been served with divorce papers, Had two phone hearings, and recently I dropped the vehicle off that we had together to him with the keys and he since then has taken it back to dealership we bought it at. Our agreement was to do a voluntary repo but since he is in the Military he is protected under some type of Act where they could not take the vehicle from me. He has not given the Finance company the information that is needed for a voluntary repo, He has not informed them of where the vehicle is, and he is refusing to sign the papers stating it is an involuntary repo. In the computer at the courts it states to get rid of the car and my ex sign the Divorce Degree he has not yet done so. When I called the Judges Chamber the man said to file some type of motion? I am confused as of what to do at this point.

If this was done in Arizona and Arizona courts are involved you need an Arizona attorney to answer your question not a North Carolina one. However, I can tell you the dealership is most likely not the correct place to take the car for a voluntary repo - the car would need to go to someone or some place designated by who ever financed it.
