In order to be eligible for a divorce in North Carolina: 1) either you or your spouse must have lived in NC for at least 6 months prior to the action for divorce being filed, 2) you must have been separated (not living together) for at least one year. In order to get the ball rolling, one of you needs to leave. If your spouse won't leave and you don't want to leave, you may want to consider conslting with a local family law attorney about a Divorce From Bed and Board.
