A 50(b) action is a civil action so you can request the case be dismissed but that is the equivalent you you 'crying wolf' and basically admitting that you at a minimum misused the Court and tax payers money because you were "upset and wasn't thinking right".. Also, you may possibly be admitting to perjury if you stated on the affidavit that he hit you when if in fact he did not.
