Legal Question in Family Law in North Carolina
My ex-wife has an Order on Temporary Custody against her, thus granting me custodial rights to the children. Though this is temporary in nature, I have had custody of two children since 2008. This order was granted by the state of Florida. I am living in North Carolina now. My ex-wife, who has phone contact with the children, now is calling the kids telling them and asking if they would like to live with her and that they might be able to. What I need to know is should I pass an injunction against her for the betterment of the children? I am also fearful she might falsely accuse me of something to try to facilitate custody. I had thought about an emergency injunction, but that might not be the best thing. What should I do?

Stop diddling around with temporary orders, hire an experienced family law attorney that you are comfortable with and look into having an action filed for an actual custody order. You did not mention how long you and the children have been living in North Carolina - so jurisdiction will be one of the first things you will need to discuss.
