Legal Question in Family Law in North Carolina

can a father take away a child ,because mom just got layed off from her job, child hate going with father because he cuss her all the time calls her names and talks bad about her mom, live in NC also father is buying guns and he flits out mom all the time and other people has seen him do it

Quick answer: probably not. North Carolina is a joint custody state. The Courts typically don't take custody/visitation rights from a parent unless they are shown to be unfit. Now, if it gets to a point where you can't support your child, that may affect the "unfit parent" test. You need to make sure you look to see what resources you can get such as food stamps and if you haven't already sought it and its appropriate in your case, you need to look at seeking child support.
