Does the father of my children have visitation rights if he does not pay child support

Generally, yes. You should not withhold visitation because the father is not paying child support. If you do withhold visitation, you will look bad in the eyes of the court unless you have some very compelling reason other than not paying child support. Of course, getting the father to pay child support is a simple trip or three to the child support enforcement division of social services. May take a little bit of time but if he has legitimate income, they will surely take a portion of it according to NC guidelines and give it to you.
