Legal Question in Family Law in North Carolina

My girlfriend/fiance lives in NC. I am in TX. We wish to be married this November at which time she, and her 9 year old daughter, would move to TX. However, NC requires written consent from the non-custodial parent before a child can be moved out of state.

If my fiance has informed the father of her intentions and her desire to discuss with him visitations and possibilities, yet he refuses to respond to emails or phone calls, what is her next step in making this happen? If he refuses to respond to her in any way, can she proceed as if consent has been given?

Who told you that NC requires the written consent of the non-custodial parent?

Is that in her custody order?
