Legal Question in Family Law in North Carolina

My grandson’s parents have a substance abuse problem and neither have gotten treatment. The paternal grandfather and step grandmother went and got emergency custody of him, when they dad overdosed without our knowledge. We have spoke with legal aid of NC and also had a consultation. We were told we have to do a motion to intervene and a custody motion to be added. The paternal grandfather and step grandmother said their attorney recommended not to do joint custody like we asked them for. They have since changed their minds and want joint. My grandson just turned 1 year old in July and has spend most of his life with my family. The step grandmother talked to her attorney this past week and was told we don’t have to do the motion to intervene. The first hearing is on 10/03/20, my daughter has not been served her papers since we don’t know where she is, so the step grandmother said it would be continued. She said her attorney would just add us on at the end. I don’t want to miss out on our rights for custody by not doing the motion.

Grandparents don't have rights. To be included you need to take some legal action. Which means you are going to need to hire an attorney - LegalAid likely ain't gonna cut it. Best of luck.
