Legal Question in Family Law in North Carolina
My husband of 17 years has recently abandoned my 3 children and myself for a woman that he has apparently been having an affair with at work. He was our sole source of income and now he doesn't want to pay me anything to be able to support myself or my children. I have no money. I need to find low cost legal help for child support. I am not interested in filing separation or divorce papers as I don't want a divorce. But he left and I have to be able to take care of our children. He abandoned us and I don't know what to do. Please help!!

You can go to your local child support enforcement office - they have low cost and often free services to establish child support. You can also go to the Dept. of Social Services to see what programs you qualify for. As to filing for separation / divorce, its nice that you don't want to but the bottom line is even if you did want to - you can't. In North Carolina, you don't file for separation, you either simply are or are not separated and like it or not - you are likely separated (i.e. you don't get to decide, you either meet the definition or you do not) as to divorce you have to be separated one year to be eligible for that. However, you can start actions for spousal support and other things so your best bet is to consult with a local family law attorney. The easiest and quickest way to resolve things is to enter into a separation agreement.
