Legal Question in Family Law in North Carolina

they left in march so it hasnt been six months yet. Now another question is I will be going to reno neveda on the 21st of june to pick the children up for the summer break. If i decide to keep them with me and not let them go back is it legal. Their is no court ordered custody. Once I have them here I will immeadiately file for emergency custody in dare county where they where living prior to moving in march..

I do not understand your question. Let me get this straight - children left in March of 2010. You are going to get the children on June 21, 2010. If heir is no custody order, then yes, you can refuse to send them back. And once you get them, you can file a custody petition. There will not be an emergency if you have the children back in your control. NC is still thre home state of the children as it has been less than 6 months since they were in NV.
