Legal Separation advice

I am a mother of two children and I am wanting a legal separation from my husband. I wish to have custody of the children since he will be leaving the country soon and returning to his native country. How do I keep my children and become legally separated and/or divorced from their father? Can I receive child support from him even if he is living in Zimbabwe?

Hello. Thank you for your inquiry. I am sorry if you are going through a difficult time with these family issues. My firm can assist you with the matters that you discuss in your inquiry.

To address some of your questions, you can - if you so desire - separate from your husband. There is no formal filing to do so. You can also resolve custody matters and child support matters either directly with him (or his attorney) or through Court intervention. You can petition the court for child support despite the fact that he is moving to Zimbabwe. There could be some issues with enforcement if he were to violate a Court Order or a term in a Seperation Agreement but those are secondary at this point.
