Legal Question in Family Law in North Carolina
is it legal for a wife to take, endorse and cash a check belonging to the husband without his consent? My wife and I file taxes separately. She lives in NC and I live in Europe. I filed my taxes and put my European address on the form but the refund was sent to my home in NC. She received the check and spent it. Do I have and recourse?

Depends on if 'your' check was solely in your name. If it was, and your wife forged your name on the endorsement to cash it - then your wife has likely committed several state and federal crimes . There is no special exemption or privilege for a wife to open your mail or cash a check in your name. The bad news is you'll likely not have an easy time getting that prosecuted with you being in Europe. Best of luck.
