Legal Question in Family Law in North Carolina

Okay, so, I’m in the middle of getting charged with 4 felonies after vandalizing a church [1 vandalism of church property with damages of $50,000 or more, 2 B&Es;, and 1 destruction of property with damages of $200 or more (a van)]. Today, I wrote a poem in creative writing that my assist. principal said she would contact cps over. [it contained mentions of drug abuse, sex, etc] I do not want to live with my mom, because she lets my rapist ex boyfriend who’s sexually, physically, and mentally abusive, stay the night and come over. I recently got fed up and called the cops to get him to leave. She has also hit/grabbed me before. Although, I did sneak out of the house, so maybe that was justified? But i’ve also been telling her for over a year now that i want to go to therapy and get mentally evaluated. i found a therapist and everything, but she never let me. I feel neglected. I want to go and live with my dad, who lives in Las Vegas. about 10 years ago, CPS deemed my house “safe if he doesn’t return” because he hit my mom. We have all since forgiven him for this [hell, my mom even had sex with him when we visited last year], and I’ve decided I want to go and live with him. He’s everything I need in a parent. He’s supportive, he loves me, and he actually listens and cares about what I have to say instead of ridiculing me every time i want to make an important decision. THE QUESTION IS, WITH EVERYTHING GOING ON AT THE MOMENT, DO Y’ALL THINK IT WOULD BE POSSIBLE FOR ME TO GO AND LIVE WITH HIM? DO YOU THINK CPS WOULD WANT TO REMOVE ME FROM THE HOME?

1 Answer from Attorneys

You need to be more concerned about your legal situation than which parent you are going to live with. If convicted you will likely be living in jail. So start tlaking more with your attorney who may be able to actually help you. Best of luck.
