Legal Question in Family Law in North Carolina

Can a Mom take her son and move to NC and file for custody there, if she lives with the father in Colorado now. but he is unhappy in the marriage and wants to take child and leave her?

If you move states, the child must live in the new state for 6 months before you can file for custody in the new state...in meantime, he can file for custody where he is and beat you tot he punch. It might be better to file in your current state to get certainty quickly. You may want to consult with a family law attorney for your options.
