Legal Question in Family Law in North Carolina

The mother of my son just got a new lawyer that I originally had a consultation with when looking for a lawyer at first, but then got the lawyer i have now.

Is she able to use a lawyer I originally consulted with?

Depends. Often Family Law attorneys will not represent the other side if there was a prior consultation but a mere prior consultation does not always prohibit an attorney from representing the other side. It all depends on if the initial consultation was to such a degree as to cause a conflict of interest. Also, sometimes when an issue comes up, one of the parties will basically have 'sham consultations' with every lawyer in town in the hopes that the other party can not retain local representation. Again, It all depends on if the initial consultation was to such a degree as to cause a legitimate conflict of interest. Also, the length of time betweeen the initial consultation and the other party retaining that attorney can be a factor. Best of luck to you!
