Can I move to England with my children

I am British by birth and am divorced in the state of NC. I want to move home to England and take my 12 year old and 16 year old with me. Neither of them want to live with their father. They currently live with me and I receive child support from their father, who also lives in NC and is a US citizen. Will I be breaking the law if I move back to England, taking the children with me? I have a large family there, whereas I have no family here in the USA. I would appreciate some advice here as I do not want my ex-husband calling the police and saying that I abducted the children.

It depends on what your child custody order says. Most standard orders would not allow you to do this. Play it safe and get a lawyer to help you get the custody order changed to allow this. You are correct in assuming there is a risk you maybe charged with kidnapping. Do not rely on a verbal agreement from your ex - just get the order changed, even if he consents.
