Legal Question in Family Law in North Carolina

First off, I'm from North Carolina. I have been in a relationship with my boyfriend since early January 2012. We have a 2 month old baby together. He is married, but has been separated from her since November 2011. We have been talking about getting engaged but he's afraid to do it before the divorce is through. Is there any legal reason he shouldn't do it now? Could he get in trouble somehow?

Engagement is not a legally recognized relationship status. That being said there is nothing would stop you from getting engaged. You just can't get married until the divorce is granted.
