Legal Question in Family Law in North Carolina

Rights of Non-wed parent

I currently live in Ohio. My daughter's father lives in North Carolina. She was born in Raleigh. Her and I immediately moved to Ohio after her birth. In Ohio, I have all rights over her since she was conceived without marriage. If I move to NC what rights will he gain? Since he doesn't pay anything now what rights will he gain if I live in NC as well as him?

Re: Rights of Non-wed parent

If you two were never married and there has never been a court proceeding concerning the child, then he is not legally the father at this time. Therefore he currently has no rights in either state.

There may be an advantage in you taking the initiative in filing for paternity and being declared the custodial parent. If you wish to know more I would need to discuss this with you. Please feel free to call for a free phone consultation. If you e-mail me, I can send you my phone number. It is also listed on my website, akronohiolaw.com . Best Regards, Edward DiCato
