Legal Question in Family Law in North Carolina
My sister in law and her husband are discussing divorce. They have a lot of property that they acquired during the marriage. He says because she cheated on him (not proven) that she can't get anything. What is the deal with this? Isn't she still entitled to half of their joint property regardless of the circumstances?

First, I cannot discuss your sister's legal problem with you. Generally, adultery relates only to a spouse's entitlement to alimony and nothing else. If it is proven that your sister did engage in marital misconduct, then she cannot get alimony. But that does not mean that she cannot get her share of the assets, as you note.
