sole custody rights

My husband and I have seperated. He gave me sole custody. Do I have the right to select someone other than him as guardian if I were to die?

Without doing research, the only way I know of to keep him from getting custody of your children at your death would be to have his parental rights terminated now. This is hard to do unless he agrees or there are compelling reasons why he should no longer have the right to be a parent. You would also need to consider the impact on your children of this action.
