Legal Question in Family Law in North Carolina
Can I sue child protective services for discrimination? The worker is black, I'm white and have a biracial daughter and two white children as well. The cps worker has gone out of her way to make it hard for me to keep my kids for no reason. She has received reports from my psychologist and therapist citing my mental state as being normal with the only issue being depression (which I take medicine for), yet she still refuses to let me have my kids without being supervised by my mother. Its ridiculous! She's a racist witch.

Sure you could sue but you'd likely lose (assuming you could even find an attorney willing to take a case like that). While the worker may have something against you (i.e. maybe she just doesn't like you) - that would not be racist. Only one thing makes you racist and that is holding the belief that your race is superior to another. While she may be racist, there is nothing in your question that supports that. So odds are she has a legitimate reason to do what she is doing. Also, your own facts being inconsistent is further indication of that . You would not receive a report of being normal if you are currently diagnosed with depression and on medication for it. While having depression is common and happens to most everyone at some point or another - having depression is not normal. Of course, most people incorrectly associate 'not normal' with something being 'wrong with them' actually all 'not normal' means is that you are in a minority - there are more people without depression than with depression. So you best bet is to be cooperative and thankful that you are allowed supervised visits with a family member.
