Support Payments
Since I will be losing my job this year, once I start receiving unemployment insurance payments (after severance is done), do I still have to pay my support payments out of my unemployment payments? How do I determine the amount, since my income is obviously depleted?

You will need to file a Motion to Reduce your child support based on a substantial change of circumstances.

You will need to prove the reduction in income and show that it did not occur as a result of bad faith on your part.
Until you file your motion, you are legally obligated to pay the full amount. Failure to pay can result in you being held in contempt. I saw a nice man taken out of the New Hanover County courtroom #302 this morning in hand cuffs for this very reason....(p.s. I did not represent him).
