Termination Paterntal rights with Step Parent Adoption

I have a 4 yr son from a previous marrige. My son only knows my current husband as daddy. With my sons sperm donor there has be little to no contact since Mar 06 and there has been no child support payed since Aug 05 and then court order support was signed Aug 06 and there has still be none. My son doesnt know his boi father from adam. Is there a case here for involuntary termination to allow my husband to legally adopt my son?
