Voluntary transfer of physical custody

My wife divorced her first husband in North Carolina. First husband was granted custody. Her daughter is now 17 and has become estranged from her father. The father wishes to relenquish custody to my wife and me. My wife and I live in Virginia - father now lives in Maryland. What do we need to do to legally transfer physical custody? What forms, where do we file, etc?

The biological father should have an attorney to represent him in this matter(which you could offer to pay for)who would prepare and file the necessary papers on behalf of his client.

It is noteworthy, however, to mention that you have not indicated whether the 17 year old minor child wishes this transfer of custody to occur which could be a very significant factor in this matter.
