if you buy a car from someone as is and they know there is a major repair and does not tell you can you take them to small claims court to try to get your money back ,are the money it cost to repair

Sure you can take them to small claims assuming you meet the jurisdictional requirements but that isn't really the question you wanted to ask. What you should have asked is what are your odds of winning. The answer to that is slim and none. Caveat emptor or let the buyer beware will most likely control in an 'as is' auto sale and the seller will have no obligation to inform you of any defects.
