Legal Question in Civil Litigation in North Carolina

Legal actions that can be taken by a mail order company?

I would like to know exactly what legal actions a mail order company can use in order to collect a debt other than going through a debt collection agency. And can a debt collection agency take you to court over the debt. Can you be sued by the mail order company that voluntarily sent the merchandise with a "no money down" advertisement? Can they sue you if you agree to pay them money but are not able to send the exact amount they are requesting by the time they requested?

Don't pay for items not ordered

That's the rule in Mass. If you are sent an unsolicited, unordered item, you need not pay for it.I do not know the law in your state, so consult a local attorney! If you did, however, accept a no-money-down offer and then found that you could not make the payments, you can trturn the item or make a new payment plan. Most companies, generally speaking, would accept an easier payment plan. But again, speak to a local atty to learn what the law is in your state. Good luck.
