Legal Question in Civil Litigation in North Carolina

My Minor Child Accidentily Caused $1000 Damage

My Minor Child Accidentily Caused $1000 Damage and I wan't to know if I am liable for the damages. My child jumped onto a golf cart that was not mine. The brake unlocked, the cart and my child rolled downhill(with myself and the owner of the cart chasing after) and struck the neighbors mobil home causing $1000 damage. The neighbor filed a claim with his insurance company, but now that company is coming after me for the full amount. I agreed to pay the neighbors deductable, but now I can't do that because it would show guilt. I don't knopw what to do and need help.

Re: My Minor Child Accidentily Caused $1000 Damage

Based on the limited information given, you would not be liable. In general, a parent is not liable for the acts of his or her child. The only exception would be if the child had a history of that sort of behavior. So, assuming your child did not have a history of hijacking golf carts, you would not be liable. Of course, we really need more facts to thoroughly answer this question. Also, if you have homeowner's insurance, it may cover the loss.
