Legal Question in Civil Litigation in North Carolina
My mother let my brother borrow her truck. She told him it needed tires tho and he had to get them. He agreed, got the tires for the truck and borrowed it. My mom has paid the insurance and tags and taxes on the truck. All he has bought is the tires gas and a starter. Now 1 year and 3 months later my mom has asked for the truck back since she can now drive again and is recovered from her surgery, he brought the truck back yesterday and called her today saying she owes him 300 for the tires. If my mom says no take it to court does she have a strong case in small claims court to win if he take her?

She has a very good case. Unless he can show that mom agreed to let him put the tires on an that she would specifically pay him back, he has no legal right to money.
