Legal Question in Civil Litigation in North Carolina

Without receipts for the work, can I sue an individual in court for taking my money but not doing the work payed for? I have text messages, voice recordings and detailed documentation of all monetary transactions, but the individual claims he used my money to pay two other people to help him, and can't return my money for the unfinished work. I have never talked two or met these two other people, and every penny was handed to the original individual. He never provided me with requested receipts for the work. If taken to court, do I have enough against him to get my money back?

Sure, you can sue but the real question you are asking - what are the odds of winning? - has so many factors, that it is virtually impossible to answer. I can say that based on the facts you presented in your question, you appear to have enough evidence - especially if you are eligible to file in small claims court. I can also tell you that your odds of winning go up dramatically if you hire an attorney. One last thing to keep in mind when making your decision to sue, even if you win you will still likely have a long road ahead of you in collecting on your judgment. Collection law is like voodoo rocket science - unless you are and attorney, it is unlikely you will be able to do much more beyond having a Sheriff's deputy execute on the judgment. If the contractor has even half a brain and knows how to structure his non- exempt assets - you may end up wasting your time and / or money on a judgment that has about the same worth as use toilet paper!
