Legal Question in Civil Litigation in North Carolina

Maybe another lawyer will have a different opinion, but my opinion (which is just that - my personal opinion) is of a very jaded view of the legal system as a whole and North Carolina in particular.

Our courts are not places of justice. I have not seen the evidence and cannot comment on what happened in your case. While you could sue the plaintiff if a truly frivolous lawsuit was brought, this requires the plaintiff's lawsuit to be decided in your favor. If you lost, it obviously was not. And even if you had the money, unless you can prove that the trial judge erred in some way, not looking at the evidence in a light favorable to you is not going to cut it with the appellate courts. I do appeals and I have a good sense of what will work and what does not. Very often they are just a waste of time unless you really have an argument.

In every case one side wins and the other must lose. I can understand why you are disgruntled, but it does not necessarily mean that the judge was biased or did not look at all the evidence. If you still believe that the judge somehow acted improperly, you can file a written complaint with the NC Judicial Standards Commission.

My experience with the Judicial Standards Commission is that they will give your complaint short shrift. They are there to protect their own (fellow judges). So unless you have very concrete evidence of wrongdoing by the judge, I would not go this route and would just move on with my life.

It is not fair and it stinks. Life is not fair and it generally stinks if you allow it to be that way. However, unless you have money to spend on lawyers, flailing away charging fraud and judicial corruption ultimately will not be a productive use of your time, money and energy.

There are many websites out there. Google "bad judges" and you will be directed to a whole host of them. There are sites for reporting bad lawyers as well.

Rather than file a judicial complaint which will go nowhere, expose the people who did you wrong! Truth is a defense - stick to facts that you can prove to be true (explain why there was fraud/corruption/bias) in your case. Share your story with others so they can avoid the same problems. That way, you will be doing something positive with your bad situation. Make lemonade out of the lemons that you have been given.
