Small Claims Court

I am intending on sueing a person in Small Claims Court.For money loaned to this person.It is only $300.00,is it worth all the trouble.I do have a conceled check for $100.00 of it but the rest was cash.But another person knows about it.Also I am not sure about how to go about it.I did send him a letter stating that if I did not recieve the money owed buy a pacific time I was going to Small claims Court.I never recieved the money.Also I do not know where he lives,all I have for a address is a P.O.box.What forms do I need to notify him that I am going to small claims?I just want to show him I am not kiding around.He is very evasive towards me and avoids me every time he sees me.Can you help me,I am living on a fixed income and need this money returned.Also can I ask for interest?

You've got several problems. First, you need to "serve" him with the Complaint, typically either by Sheriff or Certified Mail. A P.O. Box is generally insufficient. Second, if you can find him, you would have to recover the judgment, assuming you prevail at small claims court. The fact that you paid in cash is not a big problem; your testimony will show that. It is really a cost-benefit analysis for you. You will spend upwards of $100 to file the Complaint and get him served. Assuming you win (90% e.g.), you will have to collect the Judgment technically (unless he voluntarily pays it). I might suggest finding out where he lives (not necessarily easy; try phone book, any contacts you have etc.), then send him a letter by certified mail, threatening suit. Also be aware that he can appeal the Small Claims ruling, which really complicates things. You may want to consult a lawyer for more information. There is probably some good information on the Net.
