Legal Question in Immigration Law in North Carolina

I had applied for a I-129f, Petition for Alien Fiance about a year and a half ago to bring my fiance to the United States from Afghanistan. Things did not work out between us and I stopped talking to him this past May. I did not stop the application process because I was not sure. Turns out he continued the process on his own and got a U.S. visa. He is in the U.S. now and is suppose to marry me within 90 days or leave. I will not marry him. What do I need to do?

You don't need to do anything at this point, since his visa was already issued & he already entered the country.

If he does not marry you, he is required to leave. If he does not leave, he will be out of status & cannot change or adjust status, even if he marries another U.S. citizen.
