I-9 compliance is very complex and does intertwine with nationality discrimination issues. The rules contained in the M-274 regarding I-9 compliance and the subsequent policy memorandums and liaison material give excellent guidance on how to properly complete the I-9 form. This question is one which needs further factual development before proper answer can be given. Feel free to contact me. We have an office in Charlotte, NC and can perform I-9 self audit for you. If you're asking this question (and assuming you are an employer) then you need one done asap as well as some compliance training.
