More than likely, you will need to apply for a waiver. For assistance, please contact my office at 904-371-3538 or email me at [email protected].

A lot of the process will depend on how you entered the country. If you entered with inspection, you may be eligible to adjust your status while you are currently in the United States. If you entered without inspection (without a visa), you will most likely need to apply for your green card at a U.S. Consulate abroad, unless you are 245i eligible. You are 245i eligible, if someone filed an immigrant petition or labor certification on your behalf before April 30, 2001. If you are not 245i eligible, you will need to process through a U.S. Consulate with a waiver for your unlawful presence. The waiver will need to demonstrate that your U.S. Citizen spouse would suffer extreme hardship if you were not allowed to return to the U.S. The fact that your husband is in the Navy may work in your favor. Please feel free to contact me to discuss this matter further.
