Legal Question in Immigration Law in North Carolina
immigration law
Hello!
I saw a article were you were answering a question about immigration law
and I was wondering if you could help me.
I am German citizen and I am married for almost 2 years to a US citizen who is currently in the US Army.
We were staying in Belgium when he got orders to go to the US he had to transfer to a Worrior Transition Unit immediately which didn't give me any time to finish my application for the immigration visa at the embassy in Brussels.
Now I am in the US but I can only stay for 90 days since I flew in as a visitor without any visa .
I know how and where to apply for a the immigration visa but I am afraid that I did a big mistake by flying in on a waver, I heard that my status in not changeable and that I will have to fly back to Belgium to finish my paperwork?
I really don't know what to do, I really hope you can help me and give me some advise.
thank you!
''A nonimmigrant is a foreign national seeking to enter the United States (U.S.) temporarily for a specific purpose. Nonimmigrant enter the U.S. for a temporary period of time, and once in the U.S. are restricted to the activity or reason for which their visa was issued.'' ???

You may have some options available to you, but you need to carefully navigate this situation. Individuals who enter on the VWP are eligible to adjust status under certain circumstances. Please contact me at your convenience for assistance with this matter. Thanks.
Re: immigration law
Certain immigrants who entered under the VWP are eligible for an adjustment of status.
There is no doubt, however, that your case is more complicated than other adjustment of status cases, thus it is recommended to get an assistance of an experienced immigration lawyer.
