Legal Question in Immigration Law in North Carolina

Marriage

I am an american citizen. My boyfriend is here illegally from mexico, he's been here for 8 years. We live in the state of North Carolina. Is it possible for us to get married here? If so, would he be banned from the US for 10 years or can he just wait until his temporary visa arrives in his country. Would it be better for us to go to mexico and get married there? What would be the process?

It is not clear from your post what you mean by your husband is here illegally. In order to determine whether he would be eligible to apply for his green card while in the United States, I strongly recommend that your husband speak with an immigration attorney to discuss his full immigration history. At that point you can determine what the best route is for you.

You can get married whenever you want, wherever you want. That's the right of Freedom to Associate.

Whether or not you affirmatively file with immigration now or in the future is a decision that the two of you should make together. There are two avenues available (at least based off of your fact pattern). Please consult with an immigration attorney to define those strategies and help you decide.
